- Trademark infringement: this occurs when an entity uses a trademark which is identical to, or confusingly similar to a trademark owned by another entity. It can also occur in relation to products or services which are identical or similar to the products or services which the registration covers. We can identify exactly who the violating entity is, who is controlling that entity and where it is located, in preparation for legal action.
- In-use investigations: Prior to registering a new trademark, Patent Agents often find previously registered trademarks that are identical to, or confusingly similar to the proposed trademark. We are retained to determine whether or not the existing trademark is actually in use, and if so, the extent of the use, so that the ultimate client can make an informed decision on whether to proceed, and project the anticipated costs.
